HP OEM Vista refund hinges on one point
Thanks for reading!
Thank you to the over 24,000 people from Asia to Europe and everywhere in between that read my story about getting a Vista refund. It was in the top five overall on Digg at one point thanks to you - pretty exciting for someone who has never really had a website before! I thought there'd be someone out there interested in this story, but never imagined to get a response like this -
A third-party advertiser contacted me the first day that story ran and asked if I was willing to put up a link to HP's site for $50 (I declined).
An Arizona radio show called "Gutsy Geeks" asked if I would be on their show - I'll probably be a guest in a couple of weeks.
devolucion.org translated the entire story into Spanish! (of course, I've never seen at least 50% of the words before so I can't tell if it's accurate or not :P)
Clarification
Judging by some of the comments I've received, it is not obvious that getting this refund hinges on one point: You must tell HP that you agree to HP's EULA but not to Microsoft's.
I was told early on that I should return the bundle for a refund within 14 days as the HP EULA states. But, I said simply that I like the hardware and I don't necessarily disagree with HP's EULA, I just disagree with Microsoft's EULA. HP's EULA refers to itself when it says to return the bundle if you don't agree to it - it does not refer to Microsoft's EULA.
In other words, if you disagree to HP's EULA you must return the bundle. If you disagree to both HP and Microsoft's EULA, you must return the bundle. However, what if you disagree with Microsoft's EULA but not HP's? Then voila, you can return the software and not the hardware for a refund, $200 in this case.
It will be interesting to see if HP changes their EULA or if they try to change the amount you get refunded. At this moment (far as I can tell), the only room they have to squirm is around the amount. If you give it a try, let me know how it goes!
Onward
I haven't read all of the comments yet, but I've enjoyed the ones I did. There are some interesting discussions about this going on in the corners of the internet. I posted this story for educational purposes and ended up learning quite a bit myself (including a new word - portmonteau, a tiny bit of contract law, a few new words in Spanish). So thanks, everyone!
I have several new stories in the works, including coverage of my upcoming trip, funded by a Travelocity travel grant, through London to Kenya to volunteer on an Earthwatch mangrove restoration project. Stay tuned.
Pretty simple really. If you don't want Vista then don't buy a computer with Vista on it. If you read MS's EULA it says to contact the manufacturer to ask about their policy on refund, doesn't say you're entitled to one. Don't know if this is part of HP's reasoning behind not giving refunds on it but, say you were to call up and say I want a refund on Vista and a case manager issues you a refund. Well, HP has no way of voiding the Vista registration as that is on MS's system. What would keep people from calling up, getting a refund and going ahead and using the software anyway? Nothing! If you want a refund for Vista call MS.
the words came from the mouth of Glenn a manager at the complaints department where Dawn works. Not only does he say that HP will not under any circumstances give me a refund for the vista o/s but by the simple act of uninstalling my os and installing another I void my HP warrenty in full.
HP should have their EULA splash screen pop up at start up before the microsoft one.
where can I even find it?
I have contacted the EFF for information
great! =D
i'm interested in how would a store manager / reseller from HP here in Portugal get his ass out of a request like yours! xD
i hope you're enjoying your new non-Vista OS, ubuntu gnu/linux (?!), BSOD bullet proof! :p
well done!
intresting how fast a site can become well known
